Unfortunately, by-laws are not recorded documents. As a result, I only have a poor copy of a copy of the bylaws. It’s attached below:
Much of the bylaws are standard boilerplate. Unfortunately, over the years, many of the requirements set forth in this document have been ignored and people have made up their own rules. It takes only a majority vote to alter this document, so if we want to make any changes to the way things are run moving forward, this is the approach we will use.
Moving forward, we are going to revert back to this document for rules on meetings and voting. We aren’t going to invent new ones by claiming Arizona Law has superseded them unlike our predecessor has done. I paid for a HOA attorney to review our by-laws and to discuss the validity of these prior claims and he highly recommended that we follow the rules as written. So, we will be going back to proxy voting and voting at an annual meeting. The annual meeting will be done via phone conference. The main page will have the announcement with the details.
